Emails

In the interest of full disclosure, we wanted to share that we initially were experiencing frustration with the daily debris that these trees were dropping on our property, even after trimming back branches from the property line. It was while we were learning WHAT THESE TREES were, that we discovered the issues regarding Australian Pines and just how terrible they were.

As it turns out, it was that frustration of the debris, that led us to finding out that these trees were a topple risk, that they were invasive and prevented native vegetation from growing, that there was a likely reason why several of us had worsened allergic reactions several times a year. By hiring the arborists later in the year, we were shocked to find out just HOW BAD the decay on these old and oversized trees were, and what risks they posed to our properties as well as to guests.

We, the neighbors, had an in-person meeting with one of the owners while he was in town in April 2022, and we had a sit down conversation where we collectively shared our ongoing concerns about the constant debris and problems with the Australian Pine trees. In advance of hurricane season, we (the neighbors), initially offered to financially assist in removing these trees, and replacing them with a native friendly option, since we knew that it was a costly expense, but that all of us would benefit from the removal of the Australian Pine trees.

We recapped the meeting in a collective email thread... shown below.

Despite asking for a solution ahead of Hurricane Season, which starts June 1st here in South Florida, the property owners of 408 Briny didn't respond to us until July 8th, 2022. Their response email, is shared below.

We should note, that we found their response to us offensive, on many fronts. The lack of comprehension or desire to read any and all information we had provided from professional organizations regarding the Australian Pines being invasive, not good for beach/dunes, native flora or fauna, etc. was prevalent. Their response is provided below.

After this correspondence, we sat back and waited for them to provide their arborists information, but they did not (and still have not), so we decided to hire the two arborists at our own expense, then after reviewing the information, and with an impending storm (Hurricane Ian was originally coming towards Pompano Beach), we consulted an attorney to provide them with the notice (September 2022) that we were genuinely concerned for our properties and the potential damage from these trees falling/toppling during a storm or at any time, over and above the constant debris in our yards. It was at this point that we shared the arborists reports with them, through the attorney's letter, which has also been provided for review.
